Last updated: 19/10/2026

By accepting these terms of ARTEFACT, you acknowledge that you have read, understood and agreed to these general terms and conditions of sale (hereinafter the "T&Cs").

These T&Cs set out the general conditions under which ARTEFACT sells its Products (see Definitions).

These T&Cs apply between:

ARTEFACT, a simplified joint-stock company (société par actions simplifiée) with a share capital of €100,000, whose registered office is located at 34 Boulevard Carnot, 59800 LILLE, France, registered with the LILLE MÉTROPOLE Trade and Companies Register under number 890 863 475, represented by its President, Mr Benoît GOURLET,

(hereinafter "ARTEFACT");

ARTICLE 1. PURPOSE – EFFECT AND RENEWAL

The purpose of these T&Cs is to set out the terms and conditions for the sale and delivery of the Products, and to define the rights and obligations of the Parties in this context.

Placing an order for Products constitutes unreserved acceptance of these T&Cs. This acceptance can only be full and complete.

These T&Cs form the sole basis of the commercial relationship between the Parties. The Customer may not waive them in advance; any clause derogating from these terms must, in order to be valid, be accepted by ARTEFACT by any means.

They may be supplemented, where applicable, by specific conditions of sale, which complement these T&Cs and, in the event of contradiction, prevail over them.

ARTEFACT reserves the right to adapt or modify these T&Cs at any time.

It is expressly agreed between the Parties that any tolerance or waiver by either Party in the application of all or part of the commitments set out in these T&Cs, whatever its frequency and duration, shall not constitute an amendment to these T&Cs, nor create any right whatsoever.

ARTICLE 2. PURCHASE CONDITIONS

The offer for the sale and delivery of ARTEFACT Products is reserved exclusively for natural or legal persons acting as consumers or non-professionals, as defined in the French Consumer Code. The Customer expressly acknowledges ordering the Products in one of these capacities.

ARTEFACT reserves the right to make the conclusion of any sales contract conditional upon the provision of certain documents proving the Customer's identity, including but not limited to an identity document and proof of address.

ARTICLE 3. ARTEFACT'S OFFER

3.1 Product offer

ARTEFACT specialises in the sale of upcycled products, in particular bags and accessories.

These T&Cs apply to the sale and delivery of Products by ARTEFACT.

The Products offered are those listed on https://artefact.eco, while stocks last. If an ordered Product is unavailable, ARTEFACT will inform the Customer and, at its discretion, offer either to cancel the order or to deliver the ordered Products at a later date. The Customer will be refunded the sums paid for the cancelled order within thirty (30) days of the cancellation date.

Each Product is presented on the Website with a description of its main technical characteristics (capacity, use, composition, etc.).

The photographs of the Products shown on the Website are as faithful to reality as possible but are in no way binding on ARTEFACT. Furthermore, due to the upcycled nature of the Products, the Customer understands and agrees that (i) the materials they are made of may show signs of wear and (ii) the apparent colour of the Products may vary.

The Products are intended for all buyers residing in countries that fully authorise their entry into their territory. ARTEFACT shall in no event be held liable for non-compliance with the local legislation of the country to which the Product is delivered. It is the sole responsibility of the Customer to check the local regulations of the country of delivery regarding the import and use of the Products they intend to order from ARTEFACT.

3.2 Ordering Products

The Customer must carefully read these T&Cs before placing an order.

By confirming and paying for their order, the Customer irrevocably and definitively accepts these T&Cs in their entirety and acknowledges being fully aware of them.

The contractual relationship is formed when the Customer confirms and pays for their order. Consequently, the Customer knowingly accepts the content and conditions of the order, these T&Cs, and the prices, volumes, characteristics, quantities and delivery times of the Products offered for sale and ordered.

ARTICLE 4. PRICES AND PAYMENT TERMS – GUARANTEE

4.1 Prices

The price is shown when the order is confirmed.

Prices are shown in euros (€). They include any discounts and VAT applicable on the day of the order. Any change in the applicable VAT rate will be reflected in the price of the Products.

Delivery charges, shown when the order is confirmed, are invoiced in addition to the price of the Products. A flat-rate contribution to delivery costs is charged to the Customer as follows:

  • For shipments within mainland France, the minimum flat-rate contribution to delivery costs is €4 incl. VAT (unless otherwise stated);
  • For shipments to other European countries available for sale, the flat-rate contribution to delivery costs is €8 incl. VAT.

ARTEFACT reserves the right, at its sole discretion and on terms of which it shall be the sole judge, to offer promotions or price reductions.

4.2 Payment terms

4.2.1 Payment of the price
Products are payable in full on the day the order is placed.

4.2.2 Payment methods
Payment for the ordered Products is made online by secure card payment via the following secure platforms: Shopify Payments, PayPal, Apple Pay or JUST.

The Customer warrants to ARTEFACT that they hold the necessary authorisations to use the chosen payment method.

4.2.3 Invoicing
Purchase invoices are sent when the Customer places the order and on request via the contact form available at https://artefact.eco/pages/contact

Requested invoices will be sent to the billing address provided by the Customer.

Any invoice is deemed accepted and justified.

4.3 Customs duties

For orders shipped to countries outside the euro zone, customs duties and local taxes may apply when the parcel arrives in the destination country. These charges are generally around €25 to €35 (for backpacks); however, please note that our customers do not pay French VAT on these orders, which offsets part of these additional costs. Customs duties remain the sole responsibility of the Customer. We recommend checking with the relevant authorities in your country to anticipate these possible costs.

ARTICLE 5. DELIVERY OF ORDERED PRODUCTS

5.1 Place of delivery

Ordered Products will be delivered to the address indicated by the Customer as the "delivery address" when ordering (which may differ from the billing address).

5.2 Delivery charges

Delivery charges for the ordered Products are shown at the payment stage of the order.

5.3 Late delivery

Delivery times for ordered Products are given as an indication only.

However, in the event of a delivery delay of more than thirty (30) days from the order, the Customer may cancel the sales contract. In this case, ARTEFACT will refund the sums paid by the Customer (unless the Product is a "Pre-order" Product). ARTEFACT may provide the Customer with the tracking number of their parcel by email.

ARTEFACT cannot be held liable for late delivery and owes no compensation in this respect.

5.4 Delivery method

Deliveries are made by GLS or Colissimo to a pick-up point, depending on the option chosen, both tracked delivery services, in France and in the other available European countries (Germany, Austria, Belgium, Spain, Italy, Luxembourg, Netherlands, Portugal).

In the event of loss, theft, damage or deterioration of any kind of goods delivered by a carrier, it is the Customer's responsibility to take any legal action against the carrier, in accordance with articles L. 133-3 and L. 133-4 of the French Commercial Code. Any claim made more than three (3) working days after the delivery date of the Product will not be admissible. The Customer acknowledges that ARTEFACT is in no way liable for the loss, theft, damage or deterioration of the Product in this specific case. The sale price remains due.

5.5 Failed delivery

If delivery is not possible, GLS will try to find a trusted third party (concierge, neighbour, etc.) willing to accept your parcel against signature.

If no neighbour can accept it, and subject to our partner's availability, the order will be left at a nearby GLS Relay point.

If neither of these solutions is possible, our courier will automatically return your order to the GLS depot for a new delivery attempt. If the second attempt also fails, the order will be returned to the sender after a holding period of 10 working days, during which you may collect the order from the GLS depot.

In all cases, GLS will leave a delivery notice. By entering the reference on your delivery notice and the original postcode of the delivery address, you can choose a new delivery option at www.uni-track.fr ("Reschedule my delivery").

If your delivery benefits from the FlexDeliveryService, you can choose online the option that best suits your availability before the courier arrives, by clicking the link in the email and text message sent to you by GLS.

If delivery is not possible, delivery may also be made to the pick-up point selected beforehand. In this case, the Customer receives a notice that the order is available for collection at the selected pick-up point, within the period indicated on that notice.

5.6 Specific provision for "pre-order" Products

Some Products are sold as pre-orders. This is expressly stated on the Product page, together with an expected delivery date. This date is given as an indication only. ARTEFACT cannot guarantee delivery on the date indicated. In addition, the confirmation email mentioning delivery within 2–3 working days does not apply to pre-orders.

ARTICLE 6. TRANSFER OF OWNERSHIP – TRANSFER OF RISK

6.1 Transfer of ownership – Retention of title

ARTEFACT retains ownership of the Products until full payment and collection of the price and its accessories (any charges).

6.2 Transfer of risk

The risks of loss and deterioration of the Products are transferred to the Customer as soon as the Products leave ARTEFACT's premises.

ARTICLE 7. RIGHT OF WITHDRAWAL AND REFUND

In accordance with article L121-18 of the French Consumer Code, the Customer has fourteen (14) working days from receipt of the ordered Product to exercise their right of withdrawal and request an exchange or refund of the ordered Product.

This right of withdrawal may only be exercised in accordance with the procedures set out in articles 7.1 and 7.2, and provided that the returned Products meet all of the following criteria:

  • They have not been damaged and are in perfect condition; and
  • They are returned in their original packaging or similar packaging.

All return and exchange requests must be made exclusively via our returns portal: returns.itsrever.com/artefact

Article 7.1 Exchange

To request an exchange, the Customer must follow these steps:

  • Go to the returns portal within the above-mentioned period of 14 working days, enter their order number and email address, then select the Product(s) to be exchanged.
  • The Customer must pay the return fee of €8.
  • Once the request has been approved, the Customer receives a return label to attach to the parcel, together with drop-off instructions.
  • The parcel is then received by ARTEFACT's shipping department.
  • Upon receipt, the new Product is shipped within 5 working days.
  • In the event of an exchange, shipping costs for the new Product are paid by ARTEFACT.

Article 7.2 Refund

To request a refund, the Customer must follow these steps:

  • Go to the returns portal within the above-mentioned period of fourteen (14) working days, enter their order number and email address, then select the Product(s) to be returned.
  • Once the request has been approved, the Customer receives a return label to attach to the parcel, together with drop-off instructions.
  • When the Product is received at the shipping centre, ARTEFACT is notified and issues the refund within the following 7 days.
  • The refund amount corresponds strictly to the price of the returned Product(s) paid by the Customer when ordering, less the return fee of €8.
  • The refund is made to the payment method used by the Customer when ordering.

ARTICLE 8. GUARANTEES

8.1 Legal guarantee of conformity

In accordance with articles L.217-4 et seq. of the French Consumer Code, ARTEFACT is liable for any lack of conformity of the Products.

Under the legal guarantee of conformity, the Customer has two (2) years from delivery of the Products to take action.

The Customer may choose between repair or replacement of the Products, subject to the cost conditions set out in article L.217-12 of the French Consumer Code. In particular, ARTEFACT may decline the Customer's choice if it would entail a manifestly disproportionate cost compared to the other option, given the value of the Product or the significance of the defect. ARTEFACT must then, unless impossible, proceed with the option not chosen by the Customer.

In addition, any lack of conformity appearing within twenty-four (24) months of delivery of the Products is presumed, unless proven otherwise, to have existed at the time of delivery, unless this presumption is incompatible with the nature of the Products or of the defect claimed.

8.2 Guarantee against hidden defects

In accordance with articles 1641 et seq. of the French Civil Code, ARTEFACT guarantees that the Products are free from hidden defects.

Under the guarantee against hidden defects, the Customer has two (2) years from discovery of the defect to take action. In any event, the guarantee against hidden defects is limited to five (5) years from the sale of the Products.

Please note: the Customer is required to provide proof of the existence of a hidden defect.

8.3 Implementation of legal guarantees

In the event of lack of conformity or a hidden defect, the Customer must send their claim to ARTEFACT's customer service via the contact form available at https://artefact.eco/pages/contact, indicating at least their contact details and the nature of the defect observed.

The defects covered by the above guarantees must occur and be reported within the above guarantee periods.

It is expressly agreed that, where a guarantee is justifiably invoked, ARTEFACT's obligations are limited exclusively to the replacement, repair or refund of the Product, and ARTEFACT shall not be liable for any compensation of any kind or on any basis whatsoever, direct or indirect.

ARTICLE 9. LIABILITY

It is expressly agreed that ARTEFACT cannot be held liable in any way for interruptions of the Website's services caused by the Internet network.

In the distance selling process, ARTEFACT is bound only by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, service interruption or other issues. ARTEFACT in no way guarantees the Customer against the risks of misappropriation, intrusion, contamination or hacking of their data, programs and files. It is the Customer's responsibility to take all appropriate measures to protect their data.

Generally speaking, ARTEFACT cannot be held liable where the improper performance or non-performance of the obligations of the sales contract is attributable either to the Customer or to the unforeseeable and insurmountable act of a third party.

ARTICLE 10. INTELLECTUAL PROPERTY

All documentation, databases and content of any kind (texts, images, visuals, music, logos, designs and models, trademarks, databases, etc.) used by ARTEFACT in connection with the sale of the Products, and in particular the elements of the Website, are protected by all applicable intellectual property rights and database producers' rights.

Any disassembly, decompilation, decryption, extraction, reuse, copying and, more generally, any act of reproduction, representation, distribution or use of any of these elements, in whole or in part, without ARTEFACT's authorisation is strictly prohibited and may give rise to legal proceedings.

ARTICLE 11. PERSONAL DATA

ARTEFACT processes personal data in order to manage, invoice and follow up its customers' files and for prospecting purposes.

In accordance with the General Data Protection Regulation and articles 38 to 40 of the amended French law no. 78-17 of 6 January 1978 on data processing, files and freedoms, the Customer has the right to access, rectify, restrict, object to, erase and port their data. The Customer also has the right to give general or specific instructions regarding the storage, deletion and communication of their personal data.

To this end, the Customer may send any request to ARTEFACT:

  • By post to the following address: Société ARTEFACT – 34 Boulevard Carnot, 59800 LILLE, France; or
  • Via the contact form available at https://artefact.eco/pages/contact

ARTICLE 12. OBJECTION TO TELEPHONE CANVASSING

The Customer is informed that their telephone details may be used for the proper processing of their orders or to contact them for prospecting purposes.

Without prejudice to the above, in accordance with the French Consumer Code, the Customer is informed that there is an opt-out list for telephone canvassing, "Bloctel", which can be joined online at https://conso.bloctel.fr.

ARTICLE 13. FORCE MAJEURE

ARTEFACT is not liable for the total or partial non-performance of its obligations under this Contract if such non-performance is due to force majeure.

Force majeure is any irresistible event, unforeseeable at the time the contract was signed, that makes performance of this contract by ARTEFACT materially, legally or economically impossible, including any event due to forces beyond ARTEFACT's control, including but not limited to natural disasters, war, pandemics, acts of terror, civil unrest, strikes and other hostilities.

ARTEFACT must notify the Customer within five (5) working days of the occurrence of such an event.

The Parties agree to consult each other as soon as possible in order to determine together how the order will be performed for the duration of the force majeure event.

Beyond one (1) month of interruption due to force majeure, ARTEFACT may decline to fulfil the order, in which case it shall refund the Customer as soon as possible.

ARTICLE 14. VALIDITY OF THE CONTRACT

The invalidity of any clause by virtue of a law, regulation or court decision does not affect the other provisions of these T&Cs, which shall remain valid where applicable.

These T&Cs and any Quote sent to the Customer form a single contractual whole and constitute the entire contractual relationship between the Parties. In the event of contradiction between these documents, these T&Cs shall prevail.

ARTICLE 15. COMPLAINTS

Any complaint may be sent to ARTEFACT:

  • By registered letter with acknowledgement of receipt to the following address: Société ARTEFACT – 34 Boulevard Carnot, 59800 LILLE, France; or
  • Via the contact form available at https://artefact.eco/pages/contact

ARTICLE 16. GOVERNING LAW

These T&Cs are governed by French law.

The language of interpretation of these T&Cs is French.

Any dispute arising from the performance of these T&Cs, or in connection with them, between ARTEFACT and a Customer shall be submitted to the exclusive jurisdiction of the Commercial Court of LILLE, including in summary proceedings, third-party claims or where there are multiple defendants.
